Court Rejects BMWE Motion to Intervene in CSXT-NMB Litigation

 

Expressing concern over the possible outcome of the CSXT's suit against the NMB and the Carrier's ability to adequately represent the Organizations' interests in that litigation, the BMWE on September 20, 2004 filed a Motion to Intervene with the Federal District Court for the District of Columbia. (Civil Action No. 04-0611) (RWR). (See "News," May 5, 2004).

On October 1, 2004, the Carrier filed its opposition to the motion.

By Order dated October 18, 2004, United States District Judge Richard Roberts denied the Organization's effort to intervene, without prejudice.

To date, the Court has given no indication of when it might rule on the underlying dispute or order argument.
